Coleto Creek Power, LLC has applied to the Texas Commission on Environmental Quality (TCEQ) for a registration to authorize the operation and closure of an existing Coal Combustion Residuals surface impoundment. The unit is expected to complete closure no later than October 17, 2028. The facility is located at 45 FM 2987, Fannin, Goliad County, Texas 77960. TCEQ received the application on January 24, 2022. The draft registration, if approved, would establish the conditions under which the facility must operate. The Executive Director has made a preliminary decision that this registration, if issued, meets all the statutory and regulatory requirements. A public meeting is not a contested case hearing. The Executive Director will review and consider all timely comments and requests for a public meeting submitted during the comment period. The Executive Director will review the application and issue a decision.
