HUD 24 CFR Part 50 Notice

Early Notice and Public Review of a Proposed Activity in a Federal Flood Risk Management Standard Designated Floodplain To: All interested Agencies, including all Federal, State, and Local, Groups and Individuals This is to give notice that HUD under 24 CFR Part 50 has determined that the following proposed action is located in the Federal Flood Risk Management Standard (FFRMS) floodplain, and HUD will be identifying and evaluating practicable alternatives to locating the action within the floodplain and the potential impacts on the floodplain from the proposed action, as required by Executive Order 11988, as amended by Executive Order 13690, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands. This notice fulfills Step 2 (Early Public Notice) of HUD’s 8-Step decision-making process under 24 CFR 55.20. The proposed action involves the substantial improvement and rehabilitation of a multi-family apartment project, known as Anna Blackley located at 1000 South Cameron Street in Victoria, Victoria County, Texas (subject property). HUD is considering providing financial assistance for the proposed rehabilitation through a HUD Rental Assistance Demonstration (RAD)/Section 18 Blend, along with additional funding provided through the Texas Department of Housing and Community Affairs (TDHCA) 4% Low-Income Housing Tax Credit (LIHTC) program. The subject property consists of four (4) two-story multi-family apartment structures constructed in 1953. The subject property structures contain a total of twenty-eight (28) residential dwelling units and are situated on 1.803 acres of land. Exterior property improvements include landscaped regions, concrete walkways, and concrete parking areas/access drives. The subject property is proposed for rehabilitation. The subject property is serviced by electricity, natural gas, and municipally supplied water and sewer. The proposed rehabilitation activities include interior and exterior site improvements and upgrades to address federal accessibility requirements and prolong the viability and longevity of the existing residential housing complexes. According to FEMA Flood Insurance Rate Map (FIRM) #48469C-0295H, dated July 17, 2024, as confirmed via the City of Victoria County GIS accessed at https://maps.victoriatx.gov/MapViewer/PublicMap.html, the majority of the subject property is located in Unshaded Zone X, designated as an area outside the 100 and 500-year floodplain. However, the southwestern portion of the subject property is located within Shaded Zone X, designated as an area within the 500-year floodplain associated with the Guadalupe River. According to the FEMA Flood Map Service Center accessed at https://msc.fema.gov/portal/home, there are no preliminary or pending FIRMs for the subject property. Under the 0.2% Annual Chance Flood Approach (0.2PFA), the FFRMS floodplain corresponds to the mapped 500-year floodplain located on the southwestern portion of the subject property. Approximately 0.21 acres of the FFRMS floodplain encroaches onto the subject property boundaries. In order to determine the FFRMS floodplain elevation, D3G reviewed the FEMA Flood Insurance Study (FIS) #48469C-V002A, dated July 17, 2024. According to the Flood Profile for the relevant section of the Guadalupe River, the 500-year floodplain elevation at the relevant cross section (50 feet upstream of cross section AE) is listed as 59.4 feet. Since the project meets the threshold of substantial improvement as defined in 24 CFR 55.2(b)(12), it is subject to the 8-Step Process. The proposed action is not a critical action as defined by 24 CFR 55.2(b)(3). According to the ALTA/NSPS Land Title Survey prepared by Partner dated March 23, 2026, improvements in the FFRMS floodplain consist of utilities, concrete walkways/entrances to the buildings, a concrete access drive and parking area, a handicapped ramp, and landscaped regions. The concrete access drive and concrete walkways serve as ingress/egress points for select structures. Although the project meets the threshold of substantial improvement, none of the residential structures are located within the FFRMS floodplain, and therefore elevation requirements outlined in 24 CFR 55.20(e)(1) do not apply. Proposed activities in the FFRMS floodplain consist of repair and replacement of the concrete sidewalks in front of the buildings, repair and replacement of the concrete handicapped ramp, and repair and replacement of the concrete access drive and parking area. The floodplain associated with the Guadalupe River provides several important natural and beneficial functions and values. These include the temporary storage and conveyance of floodwaters, reduction of downstream flood velocities and erosion, groundwater recharge, water quality improvement through natural filtration, and the support of riparian and aquatic habitat for native vegetation and wildlife species. Floodplain areas adjacent to the Guadalupe River also contribute to open space values, scenic character, and ecological connectivity within the region. The subject property has already been impacted via the current development and no longer represents a floodplain in its natural state. The floodplain encumbers a portion of subject property and minimally provides the function of water storage. A review of the National Register of Historic Places and the Texas Historical Commission Atlas Map accessed at https://atlas.thc.texas.gov/ indicates that the subject property structures are not listed on the National Register of Historic Places; are not located within, or adjacent to, a Historic District; and are not listed as local landmarks. There are three primary purposes for this notice. First, people who may be affected by activities in floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain alternative methods to serve the same project purpose, and methods to minimize and mitigate project impacts on the floodplain. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplain can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplain, it must inform those who may be put at greater or continued risk. HUD has not made a final decision and will consider public comments prior to completing the floodplain evaluation.
