PUBLIC NOTICE INV NYLON CHEMICALS AMERICAS, LLC, VICTORIA, TEXAS FACILITY DECEMBER 15, 2025 – DECEMBER 19, 2025 INV NYLON CHEMICALS AMERICAS, LLC (INVISTA) operates six hazardous waste boilers at its Victoria, Texas, facility. These units are designated as Boilers No. 1, No. 2, No. 3, No. 4, No. 7, and No. 8. These boilers process waste generated at the Victoria facility, ensuring efficient resource use by converting it into steam that supports the same production units. On October 12, 2005, the U.S. Environmental Protection Agency (USEPA) promulgated the Phase I Final Replacement National Emissions Standards for Hazardous Air Pollutants for Hazardous Waste Combustors (HWC NESHAP) under joint authority of the Clean Air Act Amendments of 1990 (CAAA) and the Resource Conservation and Recovery Act (RCRA). Known as Maximum Achievable Control Technology (MACT) standards, the HWC NESHAP set more stringent emissions limits for incinerators that burn hazardous waste. Comprehensive Performance Tests (CPTs) are required to be performed every five years for HWC units that are subject to regulation under this NESHAP to verify that they comply with applicable HWC NESHAP regulations. INVISTA submitted a CPT Plan for the five-year re-test for Boilers No. 1 and No. 2 to the Texas Council on Environmental Quality (TCEQ) on December 11, 2024 (Revised February 28, 2025) and received approval to conduct the CPT on March 31, 2025. Prior to conducting the CPT, facilities must make the site-specific CPT Plan that describes this testing event available to the public for review. This public notice is being mailed to all persons listed on the Facility Mailing List for INVISTA’s Victoria facility and representatives of appropriate state and local government units. The test is scheduled to begin on December 15, 2025 and should be completed by December 19, 2025.
